revisiting discovery of loss and termination

Discovery and termination are core principles in financial institution bonds and commercial crime policies. Discovery begins the insured’s obligation to provide notice and a proof of loss, and it sets a limit on when the insured can file suit in the event of a coverage dispute. What exactly constitutes discovery, however, depends on the specific facts, circumstances, and applicable law. Termination is an important related concept which is essential to coverage as it shifts the risk of a known dishonest employee back to the insured. This presentation will discuss these important foundational principles and how these concepts are applied to allocate responsibilities and risks between the insurer and insured.

employee fraud: THE INTERSECTION OF COVERED PROPERTY AND CAUSATION IN THE CONTEXT OF EMPLOYEE THEFT CLAIMS

ETHICS OF AI RECORDING

The panel examines the ethical and legal implications of emerging AI-driven recording technologies within insurance claims handling. Modern communication platforms now generate transcripts, summaries, and analytical insights automatically, often blurring the line between intentional recording and ambient data capture. These capabilities raise significant concerns regarding privacy, consent, data retention, and the accuracy of AI-produced materials. The panel explores how fair claims handling statutes interact with AI transcription, evaluates the challenges posed when insureds, brokers, attorneys, and other representatives request or employ AI-based recording tools, as well as the grounds on which insurers, TPAs, and vendors may refuse such recordings. The goal is to clarify how AI recording reshapes longstanding norms in claims communication and regulatory compliance.

INSURING AGREEMENT (e): eNUMERATED dOCUMENTS

This panel focuses on the threshold requirement that the insured must rely upon an original document that falls within one of the enumerated documents listed to invoke coverage under Insuring Agreement (E).  First, they’ll examine the history and purpose of Insuring Agreement (E) coverage, the explicit requirement that it must involve a covered enumerated document and the appropriate interpretation of the specific definitions and language used for each of the listed enumerated documents in the Financial Institution Bond, Standard Form No. 24.  Next, the panel analyzes the coverage steps to evaluate whether there is coverage for an insured’s claimed enumerated document.  Finally, the panel explores the impact of the threshold enumerated document requirement on current Insuring Agreement (E) claims and claims under the commercial crime policy involving “securities”.

OTHER INSURANCE: LIABILITY HOT POTATO IN COVERAGE DISPUTES

This panel explores the role of “other insurance” provisions in allocating liability when multiple policies cover the same loss. Focusing on the three primary clause types (excess, escape, and pro rata), the authors explain how these provisions are intended to establish priority and share responsibility among insurers, yet frequently lead to disputes when competing clauses conflict. The panel also examines how courts determine which provisions apply, the concept of “mutually repugnant” clauses, and the varying judicial approaches used to resolve these conflicts across jurisdictions, including in the fidelity context. The panel concludes with practical guidance for navigating these disputes, offering strategies for identifying applicable coverage, coordinating with other insurers, and effectively managing allocation issues in real-world claims.

REGISTRATION FEES

This year the FLA is waiving the conference registration fee for any insurance company employees who are attending the FLA Annual Conference for the first time. The FLA is also offering discounted registration fees for non-insurance company employees who are attending for FLA Annual Conference for the first time, and for non-insurance company employees who are FLA sponsors this year. Please note that the waived and discounted registration fees are only available to pre-registrations and will not be available to those registering on-site. 

Registration fees include attendance at the September 23, 2026, Annual Conference, a copy of the Fidelity Law Journal Volume XXXII, and attendance at the joint reception with attendees of the ABA FSLC meeting, which will be held after the FLA Conference.

All registrations must be made online and paid by credit/debit card. Registrations may be cancelled by completing this Cancellation/Substitute Request Form before September 9, 2026. After September 9, 2026, you may send a substitute or you will receive the course materials, including a printed copy of the Fidelity Law Journal Vol. XXXI.

 

On-site registrants must register online at the conference and pay the registration fee by credit or debit card.

A limited number of rooms have been blocked for Tuesday, September 22, 2026, through Friday, September 25, 2026. The negotiated hotel room rate starts at $399.00 per night plus 14.2% taxes and fees. The room block will be held until September 1, 2026, or until exhausted. After that date, reservations will be confirmed based on availability.

 

Hotel check-in is at 4:00 p.m. and check-out is at 12:00 p.m. All reservations must be guaranteed by credit card. Individuals with guaranteed reservations must cancel their reservations no later than 72 hours before the scheduled day of arrival to avoid a one-night cancellation charge.
